Annexure I-Sample Lease Agreement

AGREEMENT TO LEASE

 THIS AGREEMENT TO LEASE is made at ________ this ____ day of ____, One Thousand Nine  Hundred  and  Ninety _______ BETWEEN Mr _____________ S/O _____________ R/O _______ hereinafter called the ‘LESSOR’ (which expression wherever  the context so  admits  shall include all his legal heirs,  administrators   and  assigns)  of  the  ONE PART and ____________ s/o _____________ R/O __________ hereinafter called the LESSEE’ (which  expression wherever the context so admits shall include its successors and  assigns) of the OTHER PART.

WHEREAS the Lessor is the lawful owner and otherwise fully entitled to all that house measuring _______ sq. yards bearing address; _________________________________ consisting of  ______  bedrooms with attached bathrooms, drawing/dining room, kitchen, lounge, car parking space (This being collectively referred to as the “Demised Premises”).

AND WHEREAS the Lessor has agreed to lease out to the Lessee the Demised  Premises  for  a  period  of ____ months commencing from the _____ day of ____ 19__ uptil the _______ day of _____ 19__ at a monthly  rent of Rs. ______  (Rupees _______________ Only) on the terms and conditions hereinafter contained.

 

IT IS HEREBY MUTUALLY AGREED AS UNDER:

  1. The Lessor shall let out to the Lessee the Demised Premises for a period of ______ months commencing  from ____ day of ____, 19___ at a monthly rent of Rs. _______ (Rupees _____________ Only). The Lessors may request that    this rent be paid in advance by the Lessee.
  2. The Lessee shall pay the charges during the rental period for telephone (if any), electricity gas and water in respect of the Demised Premises.
  3. The Lessor shall  be  responsible  for payment of all rates, taxes and assessments whatsoever payable to the Government or other  authorities in respect of the Demised Premises.
  4. The Lessee shall not be entitled to sublet the Demised Premises to any other person except with the written consent of the Lessor  which  permission  shall not be unreasonably withheld.
  5. The Lessee shall have the option to renew this Lease for    further periods upon terms and conditions to be mutually agreed between the Lessor and the Lessees.
  6. The Lessee may terminate this Agreement by giving three months written notice and in that event the Lessor shall forthwith refund to the Lessee the unappropriated amount of advance rent paid,  if any, before taking over the vacant possession of  the Demised  Premises from the  Lessee.
  7. This Agreement has been drawn up in duplicate, one original to be retained by the Lessor and the other to be retained by the Lessee.
